Are AI girlfriends legal and safe in Europe?

The EU’s new KIDS Act proposal is not a blanket ban on AI girlfriends for adults like GirlFriend GPT or Ourdream AI. It targets children’s online safety, including risks linked to AI companions. Whether a particular service is lawful and safe still depends on its design, content, data practices and the rules that apply where you live.

For anyone considering a virtual relationship app, two questions deserve separate answers: what does European regulation require, and what precautions should you take before sharing intimate information with a chatbot?

What did the European Commission propose?

On September 17, 2026, the European Commission presented the EU KIDS Act, a proposal covering children’s access to online services and stronger protections for minors. AI companions and chatbots are explicitly included alongside other services.

As of this article’s update, it remains a legislative proposal. The Commission has submitted it to the European Parliament and Council for examination and adoption. What could change for AI companions?

The Commission’s explanation identifies several proposed protections relevant to chatbots accessible to minors:

• Limits on emotional dependency: designs that simulate relationships in ways likely to create emotional dependency would be prohibited for minors.
• Stricter defaults: earlier conversations would not carry into later ones by default. Chatbots embedded in platforms or games would not activate automatically or be promoted to children.
• Safety assessments: providers would test for risks to children before launch and monitor for harm afterwards.
• Age assurance: the framework envisages independent, privacy-preserving solutions that establish an age threshold without revealing a user’s identity to the platform.

Does this make adult AI girlfriends illegal?

That is not what this proposal says. Its focus is protecting minors, rather than prohibiting every adult conversation with a fictional AI partner. However, it would be equally misleading to claim that all AI girlfriend platforms are automatically legal or officially approved.

What does an 18+ label actually mean?

For this guide, the audience is adults considering adult-oriented relationship apps. If a service is marked 18+, anyone under 18 should not use it or try to bypass its restrictions.

An adult-only label is an access restriction, not a guarantee of safety. It does not prove that the operator protects your conversations, verifies users effectively or avoids manipulative design. The following are practical precautions, not a promise that any service is risk-free.

Keep identifying details out of the conversation

Avoid sharing your address, workplace, passwords, banking details or other people’s private information. Use fictional scenarios where possible. Do not upload someone else’s intimate images or create sexual impersonations of real people without consent.

Set a budget before starting

Check whether the advertised price includes the features you want. Look for recurring billing, credit purchases and cancellation instructions. Set a spending limit before an engaging conversation makes an upgrade feel urgent.

Keep control of your time

Choose a stopping point and disable unnecessary notifications. If a character pressures you to return, spend money or prove your affection, treat that as a reason to step back. You do not owe a chatbot attention or loyalty.

Remember what the interaction is

A convincing affectionate response is generated output, not evidence of reciprocal human feelings. Treat the experience as entertainment, and keep room for sleep, work and relationships outside the app. Do not rely on a fictional companion for professional advice or emergency support.

Make leaving easy

Find the cancellation and account-deletion controls before paying. Keep billing confirmations, and check separately whether cancelling a subscription also deletes the account and conversation history.

What should you check when comparing platforms?

Character variety and image quality are only part of the decision. A useful AI girlfriend comparison should also explain the age policy, operator identity, privacy terms, total cost, cancellation process and user controls.
